Terms of Service

Welcome to Ayooba. These Terms of Service ("Terms") govern your access to and use of the Ayooba website (theayooba.com), mobile application, and related services (collectively, the "Platform"), operated by Ayooba Inc. ("Ayooba", "we", "our", or "us").

By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, you must not access or use the Platform.

1. Definitions

"User" means any individual who accesses or uses the Platform, including Explorers, Designers/Artisans, Wellness Experts, and Brands.

"Explorer" means a consumer user who browses, purchases products, books wellness appointments, or participates in community events.

"Designer/Artisan" means a registered user who showcases and sells fashion products through the Fashion Market Hub.

"Wellness Expert" means a registered therapist or counsellor who offers identity-related wellness services through the Platform.

"Brand" means a registered business entity that showcases fashion collections on the platform.

"Content" means any text, images, product listings, reviews, ratings, messages, and other materials submitted, uploaded, or displayed on the Platform.

2. Account Registration

2.1. To access certain features of the Platform (including purchasing, messaging, bookings, and marketplace participation), you must create an account by providing accurate and complete information.

2.2. You may register using an email address and password, or through third-party authentication providers (Google, Apple). You are responsible for maintaining the confidentiality of your login credentials.

2.3. You must complete our onboarding process, which may include selecting a user type (Explorer, Wellness Expert, or Brand), providing personal information, indicating your interests, and setting language and cultural preferences.

2.4. You must be at least 16 years old to create an account. If you are under 18, you must have the consent of a parent or legal guardian.

3. The Platform

3.1 Fashion Collections

Ayooba offers its own identity-led fashion collections for purchase and pre-order. Products are displayed with descriptions, pricing in multiple currencies (GBP, USD, EUR, NGN), sustainable feature information, and high-resolution imagery. All purchases are subject to our Returns Policy.

3.2 Fashion Market Hub

The Market Hub enables independent designers, artisans, and brands to list and sell their products. Ayooba acts as the marketplace facilitator, not the seller, for third-party products. All transactions between Users and Designers/Artisans are subject to separate marketplace terms. Users may interact with sellers through our in-platform chat system, leave reviews and ratings, and search for designers by locality and specialty.

3.3 Wellness Services

The Platform connects Users with registered Wellness Experts (therapists and counsellors) who provide identity-focused wellness services. Wellness Experts are independent professionals, not employees of Ayooba. Users may book appointments, conduct sessions, and provide feedback. Ayooba does not provide medical advice and is not liable for the quality of wellness services provided by third-party professionals.

3.4 TESA Community Hub

TESA (The Expression Studio by Àyọ̀ọba) provides community events, mentorship programmes, creative exhibitions, and leadership training. Event registration, attendance, and participation are governed by individual event terms where applicable.

3.5 Persona & AI Features

The Platform offers AI-powered features including persona quizzes, archetype-based outfit suggestions, and digital wardrobe management. These features are for entertainment and personal exploration purposes only and do not constitute professional advice. AI try-on features use your submitted images solely for the purpose of generating virtual try-on results and are subject to our Privacy Policy.

4. Subscription Plans

4.1. The Platform offers tiered subscription plans (Free, Premium) that unlock varying levels of access to features including AI try-on, advanced persona insights, and priority booking.

4.2. Subscription payments are processed through Stripe. By subscribing, you authorise recurring charges at the applicable rate until you cancel.

4.3. You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period. No refunds are provided for partial billing periods.

5. Payments & Transactions

5.1. The Platform accepts payment via direct credit/debit card and Google Pay, processed through secure third-party payment providers.

5.2. All prices are displayed inclusive of applicable taxes unless otherwise stated. Currency conversion is provided for reference only; your payment provider may apply different exchange rates.

5.3. For Market Hub transactions, Ayooba processes payments on behalf of Designers/Artisans and facilitates payouts according to the marketplace payout schedule.

6. User Conduct

You agree not to:

  • Use the Platform for any unlawful purpose or in violation of any applicable laws
  • Submit false, misleading, or fraudulent information in product listings, reviews, or profile details
  • Harass, abuse, or threaten other Users through chat or any communication channel
  • Circumvent Platform security measures or attempt to access other Users' accounts
  • Scrape, copy, or reproduce Platform content without express written permission
  • Use the Platform to distribute spam, malware, or unsolicited communications

7. Content & Intellectual Property

7.1. You retain ownership of Content you submit to the Platform. By submitting Content, you grant Ayooba a non-exclusive, worldwide, royalty-free licence to use, display, reproduce, and distribute your Content in connection with the Platform's operations.

7.2. The Ayooba name, logo, brand identity, and all original content, designs, and software are the exclusive property of Ayooba Inc. and are protected by intellectual property laws.

7.3. Product reviews and ratings must be honest, factual, and based on genuine experience. We reserve the right to remove reviews that violate these standards.

8. Safety & Reporting

8.1. Users may report inappropriate content, behaviour, or safety concerns through the Platform's reporting system.

8.2. Users may block other Users to prevent further interaction. Blocked users cannot send messages, view profiles, or interact with the blocking user.

8.3. Ayooba investigates all reports and may take action including content removal, account suspension, or permanent ban at its discretion.

9. Limitation of Liability

9.1. The Platform is provided "as is" and "as available" without warranties of any kind, either express or implied.

9.2. Ayooba is not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform, including but not limited to loss of profits, data, or goodwill.

9.3. Our total aggregate liability for any claims arising from or related to the Platform shall not exceed the amount you paid to Ayooba in the twelve (12) months preceding the claim.

10. Termination

10.1. You may delete your account at any time through the Platform's account settings. Account deletion is permanent and irreversible.

10.2. Ayooba may suspend or terminate your account at any time for violation of these Terms, with or without notice.

10.3. Upon termination, your right to use the Platform ceases immediately. Provisions that by their nature should survive termination (including intellectual property, limitation of liability, and dispute resolution) shall survive.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

12. Changes to These Terms

We may update these Terms from time to time. We will notify registered Users of material changes via email or in-app notification. Your continued use of the Platform after such changes constitutes acceptance of the revised Terms.
